WIN A DATE WITH CHRISTINE AND CARL CONTEST

OFFICIAL RULES & REGULATIONS

THIS CONTEST IS INTENDED FOR RESIDENTS OF CANADA ONLY AND WILL BE INTERPRETED ACCORDING TO CANADIAN LAW.

CONTEST SPONSOR:

The contest sponsor is Accessible Media Inc. (“AMI” or “Sponsor”).

HOW TO ENTER:

Submit a 250 word essay or a 0:60 (one minute) digital file uploaded to YouTube (https://www.youtube.com) explaining why you want to meet the hosts of AMI’s Four Senses television program (your “Entry”). Enter by emailing written submission or YouTube link to info@ami.ca or submit by mail in a separate envelope bearing sufficient postage to:  Win a Date with Christine and Carl Contest, Accessible Media Inc., 1090 Don Mills Rd., Suite 200, Toronto, ON, M3C 3R6.  You must provide a valid email address or phone number where we can contact you as part of your Entry. The contest runs from July 25, 2016 to September 6, 2016.  Entries are limited to one per person for the duration of the contest. Entries must be received by 11:59 p.m. (ET) on the contest closing date, Tuesday, September 6, 2016. No purchase necessary. All entries become the property of AMI and none will be returned. Winning entry will be posted online at http://www.ami.ca/contest.

AMI accepts no responsibility for entries that are lost, stolen, late, misdirected, illegible, incomplete, delayed, damaged, destroyed or postage due mail entries.  AMI is also not responsible for the failure or malfunction of any hardware, software, telecommunication component, computer, online systems or services, or traffic congestion on the Internet or at any website relating to online entries, and assumes no liability for damage to an entrant’s or any person’s computer or other device resulting from participating in this contest.

In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be deemed to have been made by the authorized account holder of the email address at the time of entry.  “Authorized account holder” is the natural person who is assigned an email address by an Internet service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question.

GRAND PRIZE SELECTION:

One Grand Prize winner will be selected from among all eligible entries at 12 noon on Friday, September 9, 2016 in Toronto, Ontario by a panel of judges consisting of representatives from the Sponsor. The judges will award the Grand Prize based on the creativity and individuality of the Entry. The criteria to be used for judging and their relative weight will be as follows:  creativity (40%); individuality (35%); and appropriateness to the theme (25%).  In the event of a tie, the entrant with the highest score for creativity will be declared the winner.

The selected entrant will be notified by email, or if there is no email address, by phone, on Friday, September 9, 2016. In order to win, selected winner must correctly answer a mathematical skill-testing question.

Odds of winning depend on the total number of eligible online and mail entries received by the contest closing date.

GRAND PRIZE:

There will be one Grand Prize, consisting of a two (2) night trip for two (2) persons to Toronto, Ontario to visit the set of AMI’s Four Senses television program.  Trip includes:

  • Two (2) round-trip economy (coach) class airfares between the major Canadian gateway airport closest to the winner’s residence and the Toronto Pearson International Airport;
  • Two (2) nights’ standard hotel accommodation at the Intercontinental Hotel (225 Front Street West, Toronto) based on one (1) room (maximum of two (2) persons occupancy per room).
  • A meet and greet with Four Senses hosts, Christine Ha and Carl Heinrich, at the Four Senses studio (Pie in the Sky, 397 Donlands Avenue, Toronto) on Thursday, September 29, 2016;
  • Dinner for two (2) at Richmond Station restaurant located in downtown Toronto (maximum $150 including taxes and gratuities);
  • Breakfast with Christine Ha and Carl Heinrich on the set of Four Senses on Friday, September 30, 2016;
  • Round trip transportation from the Intercontinental Hotel (225 Front Street West, Toronto) to the Four Senses studio
  • An autographed copy of Christine Ha’s cookbook, Recipes From My Home Kitchen; and
  • $150 (CDN) spending money.

    Please note:

Costs and expenses incurred by the Grand Prize winner and/or his/her guest in claiming or using the prize and which are not outlined in the above prize description are the sole responsibility of the Grand Prize winner and his/her guest and include but are not limited to:  applicable airport departure taxes, airport parking fees, airport improvement fees or similar charges; transportation between winner’s home and gateway airport; transportation costs in Toronto with the exception of from the Intercontinental Hotel to the Four Senses studio; medical and travel insurance; hotel room service; laundry service; local and long distance telephone calls; merchandise and souvenirs; other meals; incidental expenses; gratuities; and all other costs and expenses not specifically included in the above prize description.

Approximate retail value of the Grand Prize (based on Vancouver departure example) is $1,950 (CDN) which includes Government taxes.  Estimated per-person round-trip airfare is $600 (CDN).

The Grand Prize rules include, but are not limited to:

  1. Prize must be taken on the following dates:September 29, 2016 to October 1, 2016 inclusive– no exceptions.If selected entrant is unable to travel within these dates, his/her Grand Prize will be forfeited and an alternate Grand Prize winner may be selected, in Sponsor’s sole discretion and time-permitting, in accordance with the selection criteria noted above.
  2. Prize is for the winner and one guest of the winner’s choosing.
  3. Winner and guest must travel together on specified itinerary.
  4. At least one adult (21 years or older) must be part of the group travelling.
  5. Grand Prize has no cash value.Prize must be accepted as awarded and is not convertible to cash. Prize may not be sold, traded or transferred.
  6. No substitutions, except at Sponsor’s option.Sponsor reserves the right in its absolute discretion to substitute a prize or prize component for one of equal or greater retail value for any reason whatsoever.
  7. Winner and guest are responsible for providing proper citizenship documentation to travel, which may include passports or valid drivers’ licenses. Sponsor is not responsible if winner and/or travelling companion are denied entry into Toronto for any reason.
  8. Prize elements may be subject to additional restrictions.
  9. The travel date and arrangements are subject to change based on availability and providers’ approval.
  10. Any portion of the Grand Prize not accepted by winner will be forfeited.

Should the Grand Prize winner refuse the Grand Prize and/or refuse to abide by any of the above-noted rules, AMI and its respective advertising and promotional agencies are released from any obligation related to the Grand Prize winner.

CONDITIONS OF WINNING:

The selected winner will be required to sign and return a declaration of eligibility and a liability/publicity release, releasing AMI and its respective advertising and promotional agencies from any damage or loss that may result from entering this contest or accepting and/or utilizing the Grand Prize.  The travelling companion of the selected winner (or the parent/legal guardian of the travelling companion who is under the age of majority) will also be required to sign a standard liability/publicity release.

Selected winner must return the completed contest documents to AMI by Wednesday, September 14, 2016.

If a selected winner cannot be contacted by email or phone, or fails to return the completed contest documents to AMI within the specified time, he/she will be disqualified, his/her Grand Prize will be forfeited and an alternate Grand Prize winner may be selected, in the sole discretion of the Sponsor and time-permitting, in accordance with the selection criteria noted above.  The new selected winner must return the completed contest documents to AMI within three (3) days of receipt. 

By entering this contest, contestants agree to AMI’s use of their photographs, names, and cities of residence, without compensation, for publicity relating to the contest, whether online (ami.ca), on radio or televised.

ELIGIBILITY:

This contest is open to all residents of Canada who are over the legal age of majority in their province or territory of residence except employees, directors, officers, representatives and agents (and persons with whom they are domiciled, whether related or not) of AMI and its advertising and promotion agencies.

By participating in this contest, each entrant agrees to be bound by these Official Rules & Regulations (the “Rules”) and by the interpretation of these Rules by the Sponsor, and further warrants and represents that his or her Entry:

  • is original to him or her and that the entrant has all necessary rights in and to the Entry used to enter this contest;
  • does not violate any law, statute, ordinance or regulation;
  • does not contain any reference to any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;
  • will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
  • is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
  • explicit, graphic or excessive sexual activity;
  • crude, vulgar or offensive language and/or symbols;
  • derogatory characterizations of any ethnic, racial, sexual or religious groups;
  • content that endorses, condones or discusses any illegal, inappropriate or risky activity, behavior or conduct;
  • personal information of individuals, including, without limitation, names and addresses (physical or email);
  • conduct or other activities in violation of these Rules;
  • commercial messages, comparisons or solicitations for products or services other than those of Sponsor;
  • any identifiable third party products and/or trade-marks or brands;
  • any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole discretion.

The Sponsor reserves the right, in its sole discretion, to edit or modify any Entry, or to request an entrant to modify or edit his or her Entry, in order to ensure that the Entry complies with these Rules, or for any other reason.

By entering this contest and submitting the Entry, each entrant:  (a) grants to the Sponsor, in perpetuity, a worldwide, non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the Entry, in whole or in part, for advertising or promoting the Four Senses television program and/or the Sponsor or for any other reason; (b) waives all moral rights in and to his or her Entry in favour of the Sponsor (and anyone authorized by the Sponsor to use the Entry); and (c) agrees to release and hold harmless the Sponsor and its agents, employees, directors, successors and assigns (collectively, the “Releases”) against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property-related cause of action.  For greater certainty, the Sponsor reserves the right, in its sole discretion, to modify, edit or remove any Entry, or to request an entrant to modify or edit his or her Entry, if a complaint is received with respect to the Entry, or for any other reason.

GENERAL: 

This contest is subject to all applicable federal, provincial and municipal laws.  By entering this contest, participants agree to be bound by these Rules and by the decisions of the contest judges and the Sponsor, which shall be final on all matters relating to this contest. 

No correspondence will be entered into with entrants, except with the selected winner(s) and individuals requesting a copy of these Rules.

The personal information provided by entrants will only be used for the purpose of administration of this contest, unless the entrant otherwise agrees in accordance with AMI’s privacy policy posted on our website at http://www.ami.ca/website-privacy-policy.

If for any reason the online portion of this contest is not capable of being completed as planned because of, but not limited to, computer virus, bugs, tampering, technical failures or other causes beyond the control of the Sponsor, Sponsor reserves the right, to cancel, suspend or modify the online portion of the contest.

AMI and its respective affiliates, advertising and promotional agencies accept no responsibility in any case where their inability to satisfy these Rules arises from any situation which is outside of their control including but not limited to a situation of strike, lock-out or other labour strife in the Sponsor’s workplaces or in the workplaces of any organization or entity whose services are used for running this contest.

Any attempt to deliberately damage any website or to undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

Sponsor reserves the right, to terminate or alter the rules of this contest at any time without notice for any reason whatsoever.

FOR RESIDENTS OF QUEBEC:

Any litigation concerning the conduct or administration of this contest maybe submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation concerning the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

In the event of any discrepancy or inconsistency between the English-language version and the French-language version of the Rules, as applicable, the English version shall prevail, govern and control.
